How foreclosure works in Texas
Most Texas foreclosures happen out of court. If your loan uses a deed of trust with a power of sale, the lender can sell the house at a public auction without filing a lawsuit. Some loans, like home equity loans and reverse mortgages, need a court order first.
For a house you live in, the Texas Property Code lays out these steps:
- Notice of default: The servicer has to send you written notice by certified mail and give you at least 20 days to catch up before it can send a notice of sale.
- Notice of sale: That notice has to go out at least 21 days before the sale date.
- The sale: Auctions happen on the first Tuesday of the month between 10 a.m. and 4 p.m. (the first Wednesday when that Tuesday is January 1 or July 4), in the area the county commissioners court designates. That's usually at the courthouse, but a county can choose another public place nearby. Harris County, for example, uses the Bayou City Event Center.
Add those minimums together and there can be roughly six weeks between the first notice and the auction. Talk to your lender and a HUD-approved housing counselor about options like reinstatement or a loan modification. If selling turns out to be the right move, reach out early. A sale that closes before the auction pays off the loan, but only when there's time to finish the title work and get a payoff. This is general information, not legal advice.

Questions sellers ask
Do you really buy houses anywhere in Texas?
Yes. MarKey Home Buyers buys houses across Texas, in cities, suburbs and small towns. We’re based in Atlanta, work with Texas sellers by phone and online, and close through a title company.
How long does foreclosure take in Texas?
Most Texas foreclosures skip the courts, so they can move fast. For the home you live in, the servicer must give you at least 20 days to cure the default before sending a notice of sale, and that notice must go out at least 21 days before the first-Tuesday auction. If you already have a sale date, send it to us right away.
Where are foreclosure auctions held in Texas?
Each county’s commissioners court designates the spot, usually at the courthouse. Some counties use another public place nearby; Harris County holds its sales at the Bayou City Event Center on Knight Road, and Dallas County uses the north side of the George Allen Courts Building. By law, your notice of sale has to state the earliest time the sale will begin.
Can I sell my house fast in Texas if it needs major repairs?
Yes. We buy houses as-is, so you don’t have to fix, clean or stage anything. The condition is part of our offer, not a to-do list for you.
Do cash home buyers in Texas charge fees?
Some buyers do, so ask before you sign. MarKey charges no fees or commissions and pays typical closing costs, and we’ll show you what you’d walk away with before you agree to anything.
